Question 3 (Essay) In a recent group of decisions (2004-FOR-020 (a) and 2004-FOR-025(a)) the Forest Appeal Commission (FAC) was asked to interpret the wording of the Silviculture Regulation (BC Reg.147/88) relating to stocking standards. At issue was whether two blocks had met the target stocking obligations of the prescription even though there were significant areas in each of the blocks that were either under or over stocked. However, if the number of trees in the blocks were averaged at the standard unit level of stratification, they met the free growing target number of trees prescribed.
